    The Growing Bind

    We hear it all the time from General Counsels: the work is piling up, the team is stretched, and although the urgency is clear, the solution often isn't. Handling the surge internally threatens to strain the team, hiring someone new for what may prove to be a temporary peak is hard to justify, and engaging an outside law firm brings its own litany of drawbacks.

    This sort of bind is increasingly widespread. Legal workloads are rising, but according to a recent industry report, the number of legal departments expecting to increase spending on outside counsel fell from over half in 2025 to just above a third in 2026. Only 32% expect to grow headcount.

    The Law Firm Dilemma

    For certain matters and transactions, there is no substitute for excellent outside law firms. As a former AmLaw 50 Managing Partner, I understand the value of great leadership and the ability to pull together large teams.

    But I also understand the frustrations that accompany this arrangement (beyond the high costs!). One common issue is lawyer turnover in the middle of an engagement, which requires finding a suitable replacement and getting them up to speed, causing disruptive delays. Another is using complex matters as a training ground for junior associates, often explained by supervising partners as a strategic staffing decision. Clients don't like these realities but often feel they have no choice but to put up with them.

    Two Approaches That Work

    It doesn't have to be this way. Even on highly sophisticated matters requiring quick action and deep expertise, fractional legal talent can be an ideal choice.

    Two approaches tend to work particularly well. The first is surge support: an experienced lawyer who steps in, gets up to speed fast, and handles the work with the judgment that comes from having done it before. No learning curve, no delays sorting out conflicts of interest. Just immediate impact.

    The second is what we call twinning: when a fractional lawyer serves as a supplemental source of information and brainpower for a general counsel or in-house legal team. If a GC has never been through or led the legal function of a cross-border expansion, restructuring, or governance matter, for instance, the "twin" can fill the gap. I've seen this make for a far smoother and less expensive matter.
